Who we are and what these Terms cover
These Terms of Use (the “Terms”) are an agreement between you and Nahnu Fitness LLC (“Nahnu”, “we”, “us” or “our”), a company based in Spokane, Washington, that publishes Nahnu Plugins.
They apply to your use of:
- Nahnu Login Shield, our WordPress plugin (the “Plugin”);
- this website at nahnuloginsheild.com, including its documentation and pages (the “Website”); and
- the support, security-report and integration-request services we offer through the Website (together with the Plugin and the Website, the “Services”).
These Terms work together with our Acceptable Use, Privacy Policy, Cookie Policy and Disclaimers pages, which are part of the agreement.
Accepting these Terms
By downloading, installing, activating or using the Plugin, or by visiting or using the Website, you agree to these Terms. If you don’t agree, please don’t use the Services.
You must be at least 18 years old to use the Services. If you use them on behalf of a company or other organization, you confirm that you have the authority to bind it to these Terms, and “you” includes that organization.
The Plugin and its license
The Plugin is free software. Its source code is licensed under the GNU General Public License, version 2 or later (“GPL”). The GPL gives you the right to use, study, change and share the code, under its conditions.
- The GPL controls the code. Nothing in these Terms limits the rights the GPL gives you in the Plugin’s source code. If these Terms and the GPL conflict about the code, the GPL wins.
- These Terms control everything else, including how you use the Website and our support services, and the limits on our responsibility described below.
- No license key, no account. The Plugin doesn’t require a license key, and everything in it is included.
- Where to get it. The official version is distributed through WordPress.org. Copies from other sources may have been changed, and we can’t vouch for them.
The Website and our content
Except for the Plugin’s GPL-licensed code, the Website and everything on it (including text, documentation, graphics, the layout and the logo) belongs to Nahnu or its licensors and is protected by copyright and other laws.
You may read the Website and its documentation, and link to it. You may quote short portions with credit and a link back. Beyond that, please ask us first through the support page.
Names and logos. “Nahnu”, “Nahnu Plugins”, “Nahnu Login Shield” and our logos are our trademarks. The GPL doesn’t grant any right to use them. You may use the Plugin’s name accurately to say that you use or recommend it, but not in a way that suggests we endorse or are affiliated with you or your product.
WordPress is a trademark of the WordPress Foundation. All other product and company names mentioned on the Website belong to their respective owners. We are not affiliated with or endorsed by them unless we say so.
Free service, and support as time allows
The Plugin and the Website are free to use, and we don’t charge for support.
- Support has no guarantees. We answer questions and reports through the support page as time allows. We don’t promise a response time, a fix, a feature, or any particular outcome. Reports from people locked out of their site, and security issues, are read first.
- Features can change. We may add, change, limit or remove features, integrations and documentation at any time, with or without notice.
- Integrations are not promised. We add integrations based on what people ask for and on our available time. Asking for one doesn’t guarantee that we’ll build it.
- No obligation to continue. We may stop developing the Plugin, stop supporting a version, or take down the Website at any time.
Your responsibilities
A login-security plugin is one layer of protection, not a complete security solution. You are responsible for your own website, and in particular for:
- Backups and testing. Keep current backups, and test the Plugin and each setting on a staging site or at a low-risk time before relying on it. Security settings (for example lockouts, geo-blocking, CAPTCHA or two-factor sign-in) can stop legitimate users, including you.
- Recovery. Make sure you know how to get back in if you’re locked out. The support page explains how.
- Your configuration. Choosing settings that fit your site, your users and your risk, and keeping WordPress, PHP, your theme and your other plugins up to date.
- Your own compliance. Following the laws that apply to you as a site owner. For example, the Plugin may log information such as IP addresses and usernames on your site, and some features may use third-party services. You decide which features to use and how, and you are responsible for any notices, consents, retention periods and legal bases that your use requires.
- Your accounts and credentials. Keeping your passwords, API keys, recovery codes and bypass settings secure.
Third-party services and integrations
The Plugin works with, and some features connect to, services we don’t own or control. Examples include CAPTCHA providers, CDN and edge services, IP-geolocation services, form plugins, e-commerce plugins, page builders, WordPress.org and your hosting provider.
- Their terms apply. Your use of any third-party service is governed by that provider’s own terms and privacy policy, and you are responsible for accepting them, for any fees, and for any API keys or accounts you need.
- They may collect data. When you turn on a feature that uses a third-party service, information such as visitor IP addresses or form details may be sent to that service. What that provider does with the data is between you and them, not us.
- We don’t control them. We aren’t responsible for their availability, accuracy, security, changes, outages, or the way they handle data. If a service changes or stops working, the related feature may stop working.
- No endorsement. Listing or supporting a service doesn’t mean we recommend it or are affiliated with it.
Data and privacy
We don’t collect data about you or your visitors through the Plugin. The Plugin is designed to store its settings and logs in your own WordPress database, and we don’t receive them.
The Website’s support, security-report and integration-request forms do receive whatever you choose to type into them, such as your name, email address and message, which we use to reply to you. Our Privacy Policy and Cookie Policy explain this in more detail.
As described above, third-party services and integrations you enable may collect data, and that is their responsibility and yours, not ours.
Feedback, requests and ideas
You can send us bug reports, suggestions, integration requests and other feedback through the support page. If you do, you agree that we may use it for any purpose, including in the Plugin or the Website, without owing you credit, payment or any other obligation. Please don’t include confidential or sensitive information in feedback.
Reporting security issues
If you think you’ve found a security problem in the Plugin or the Website, please tell us through the support page. Choose the support option and say it’s a security report, and please don’t include full technical details in public places such as forums or social media.
To help us fix issues safely, we ask that you:
- give us a reasonable amount of time to look into the report and release a fix before you share details publicly;
- make a good-faith effort not to access, change or delete data that isn’t yours, and not to disrupt, overload or degrade any website or service; and
- test only on sites and systems you own or have permission to test.
If you follow these steps, we will treat your research as a good-faith effort to help. We don’t run a paid bug-bounty program and can’t promise a fix by any particular date. This section doesn’t give you permission to break the law or to test other people’s sites.
Acceptable use
You agree to use the Services lawfully and in line with our Acceptable Use page. In short, don’t misuse the Services, interfere with them or other people’s use of them, try to break into or overload them, or use them to harm others or to break the law.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, FREE OF CHARGE, WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, NAHNU DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
NAHNU DOES NOT WARRANT THAT THE PLUGIN WILL PREVENT ANY ATTACK, INTRUSION, SPAM OR UNAUTHORIZED ACCESS, THAT IT WILL BE COMPATIBLE WITH YOUR THEME, PLUGINS, HOSTING OR CDN, OR THAT IT WILL NOT LOCK OUT LEGITIMATE USERS. SECURITY CANNOT BE GUARANTEED.
Our Disclaimers page gives more detail. Some places don’t allow certain disclaimers, so some of this may not apply to you.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NAHNU FITNESS LLC, AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OR SITE ACCESS, EVEN IF WE’VE BEEN ADVISED THAT THEY MIGHT HAPPEN, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.
BECAUSE THE SERVICES ARE FREE, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED US$0. IF A COURT DECIDES THAT LIMIT CAN’T BE ENFORCED, OUR TOTAL LIABILITY WILL NOT EXCEED US$50.
These limits apply to every kind of claim, including contract, tort (including negligence), strict liability and statutory claims. They don’t limit liability that can’t legally be limited, such as liability for fraud or for willful misconduct. Some places don’t allow the exclusion or limitation of certain damages, so some of this may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Nahnu Fitness LLC and its owners, members, managers, employees, contractors and agents from any claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your website or its users, your breach of these Terms, your violation of any law or third-party right, or your use of any third-party service with the Plugin.
Ending your use, and our right to suspend
You can stop using the Services at any time by deactivating and deleting the Plugin and no longer using the Website.
We may suspend or end your access to the Website, our support and our request forms at any time, for any reason, including if you break these Terms or our Acceptable Use page. Because the Plugin’s code is licensed under the GPL, we can’t take back the rights the GPL has already given you in copies you have.
Sections that by their nature should continue after these Terms end (including the sections on ownership, disclaimers, limitation of liability, indemnification, and governing law and disputes) will continue.
Governing law and disputes
- Governing law. These Terms, and any dispute arising out of or related to them or the Services, are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules.
- Talk to us first. Before filing a claim, you agree to send us a written description of the problem through the support page and to try in good faith to resolve it informally for at least 30 days.
- Venue. If we can’t resolve it, you agree that the state courts located in Spokane County, Washington, or the United States District Court for the Eastern District of Washington, are the exclusive places to bring the claim, and you consent to their jurisdiction.
- No class actions. To the extent permitted by law, you may bring claims against us only on your own behalf, and not as a plaintiff or class member in any class, collective or representative action.
- Time limit. To the extent permitted by law, any claim related to the Services or these Terms must be filed within one (1) year after it arose, or it is permanently barred.
- Court orders. Either of us may ask a court for an injunction or similar relief to protect intellectual property or confidential information.
Changes to these Terms and to the Plugin
We may update these Terms from time to time. When we do, we’ll post the new version on this page and change the “Last updated” date at the top. If you keep using the Services after an update, you accept the updated Terms. If you don’t agree, stop using the Services.
Changes to the Plugin itself, such as new features, fixes and removals, are listed in the changelog on the Plugin’s WordPress.org page.
General terms
- Entire agreement. These Terms and the pages they link to are the whole agreement between you and us about the Services, and replace earlier understandings about them. For the Plugin’s source code, the GPL also applies.
- If a part doesn’t work. If a court finds part of these Terms unenforceable, the rest stays in effect, and the unenforceable part is replaced with the closest enforceable one.
- No waiver. If we don’t enforce a right right away, we haven’t given it up.
- Assignment. You may not transfer your rights under these Terms without our written permission. We may transfer ours, for example in a sale or reorganization of our business.
- Notices. We may give you notice by posting on the Website, or by replying to a message you sent us. You may give us notice through the support page.
- No third-party beneficiaries. These Terms don’t give rights to anyone other than you and us.
- Events beyond our control. We aren’t responsible for delays or failures caused by events outside our reasonable control.
- Headings. Headings are for convenience and don’t change the meaning of these Terms.
